Here is a roadmap of some of the steps we might take:

If you are a current employee.

These include:

  • Harassment
  • Discrimination
  • Failure to Provide Accommodations for a Disability
  • Failure to Provide Leave for a Medical Issue: Sick Days, Doctor’s Appointments, Disabilities, Pregnancy, Stress Leave, etc.
  • Unpaid Wages: Working off the clock, unpaid overtime, unpaid or underpaid commissions and/or bonuses, missed breaks, vacation pay, sick pay, expenses.

I can write several types of letters, as listed above, for you to your employer.

It is advisable to use an attorney’s services for this. Small fee applies.

A severance package is money, usually in the form of a certain number of weeks pay, that an employer offers a separating employee for signing a release of claims, a promise not to sue. I can work on getting you a package, or on raising the number of weeks your employer is offering.

If you are a former employee.

For:

  • Wrongful Termination/Discrimination

  • Unpaid Wages: Working off the clock, unpaid overtime, unpaid or underpaid commissions and/or bonuses, missed breaks, vacation pay, sick pay, expenses.No attorney needed, forms provided upon submission of email.

     

    Pros: Does not require an attorney. Speed and convenience.

    Cons: Settlements typically are significantly less than can be obtained by an attorney.

An attorney is needed. Fee is a negotiated percentage of the settlement amount. No settlement, no fee.

Pros: Speed, convenience, no costs due.

Cons: Settlements typically are significantly less than after litigating a case, with some exceptions.

An attorney is needed. Fee is a negotiated percentage of the verdict or the settlement amount. No settlement or verdict, no fee, but may pay “costs” of litigation – expert witness fees, administrative fees.

Pros: Possibility of large verdict, or settlement larger than after a demand letter only.

Cons: Slower, depositions often needed, scrutiny of social media/email/reputation, etc. Possible liability for costs.

Litigation services are based on a contingency fee.

This means that you don’t pay me out of pocket.  Attorneys’ fees are a percentage of the amount recovered from your employer.  This “no win, no fee" structure is good for both parties, because it aligns the financial interests of the client and the attorney, and it means that you won’t be going into debt to pay your legal fees.

 

But, you may decide you don’t need an attorney and wish to pursue the case on your own.
