With the exception of enrolling in a loyalty program or other offer, merchants are not allowed to ask you for your zip code, email address, or telephone number before you buy something.

The strongest cases involve being asked, “what is your zip code” or “what is your email” by a cashier prior to ringing up your purchase. If you reasonably believe that giving the information is a condition of buying the item, then your rights were violated.

This area of the law is now growing to encompass online purchases, where the information being asked is not required for legitimate shipping and billing purposes.
