California goes to great lengths to protect the rights of disabled individuals. You cannot be terminated because of your disability.
A disability is something like a disease, disorder, or ongoing injury as opposed to something short-term like a broken leg. If you have a disability that makes you unable to perform your job, your employer is required to sit down with you and review other positions at the company of comparable pay that would fit with your ability. If your employer fails to do that and terminates you instead, they have broken the law. You also cannot be terminated just because your FMLA leave time runs out and you are still unable to return to work.
Marc Phelps works hard to ensure that his clients’ rights are protected and companies are held accountable for their actions. If you have reason to believe you have been the victim of disability discrimination, contact Marc for a free case evaluation.
